1. Agreement to Terms

By accessing or using the Vichar.io website (https://vichar.io), our AI models, APIs, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, then you may not access the Services.

2. Use of Services

You may use the Services only in compliance with these Terms and all applicable local, state, national, and international laws, rules, and regulations. You agree not to misuse the Services. For example, you must not, and must not attempt to:

• Interfere with or disrupt the Services or servers or networks connected to the Services.
• Use the Services for any illegal or unauthorized purpose.
• Generate content that is harmful, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
• Attempt to reverse engineer, decompile, or discover the source code or underlying algorithms of the Services, including our AI models.
• Use any automated system, including without limitation "robots," "spiders," or "offline readers," to access the Services in a manner that sends more request messages to the servers than a human can reasonably produce in the same period by using a conventional web browser.

3. Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.

4. Intellectual Property

The Services and their original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Vichar.io and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Vichar.io.

Regarding content generated by you using our Services ("Output Content"): Subject to your compliance with these Terms, Vichar.io grants you a non-exclusive, worldwide license to use the Output Content for any purpose, including commercial purposes. However, you are responsible for ensuring that your use of Output Content complies with applicable laws and does not infringe on the rights of third parties. Due to the nature of machine learning, Output Content may not be unique across users and the Services may generate the same or similar output for Vichar.io or a third party.

5. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

6. Disclaimer of Warranties

The Services are provided on an "AS IS" and "AS AVAILABLE" basis. Vichar.io makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Vichar.io does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site. AI models may produce inaccurate or offensive content; you should evaluate the accuracy of any Output Content as appropriate for your use case.

7. Limitation of Liability

In no event shall Vichar.io, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

9. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
